These Terms and Conditions ("Terms") govern your use of the website located at www.axiommanufacturing.com (the "Website") and all services provided by Axiom Manufacturing LLC ("we," "us," "our," or "Axiom Manufacturing"), a Utah limited liability company. This includes requesting quotes, placing orders, and purchasing custom fabrication services or products.

By accessing the Website, submitting a quote request form, or engaging our services, you agree to these Terms. If you do not agree, please do not use the Website or our services.

1. Website Use

  • The Website is provided for informational purposes and to facilitate quote requests.

  • You may not use the Website for any unlawful purpose, to interfere with its operation, or to transmit harmful code.

  • All content on the Website (text, images, logos) is owned by us or our licensors and protected by copyright and other laws. You may not reproduce or distribute it without permission.

2. Quote Requests and Orders

  • Quote requests submitted via the Website are non-binding inquiries.

  • Any quote we provide is an estimate based on information you supply and is valid for 30 days unless otherwise stated.

  • Quotes may change due to variations in materials, labor, specifications, or market conditions.

  • An order becomes binding only upon your written acceptance (e.g., email confirmation) and our acknowledgment, typically accompanied by a required deposit.

  • We reserve the right to accept or decline any order or quote request at our discretion.

3. Custom Fabrication Services

  • All products are custom-made to your specifications. You are responsible for providing accurate and complete details.

  • Custom items are non-cancelable and non-refundable once production has begun.

  • We may require approval of drawings or prototypes before proceeding.

4. Pricing and Payment

  • Prices in quotes exclude applicable taxes, shipping, handling, or other fees unless explicitly stated.

  • Payment terms: 50% non-refundable deposit due upon order acceptance; balance due prior to delivery, shipment, or pickup.

  • Acceptable payment methods: wire transfer, ACH bank transfer, check, credit card.  If paying by check, it must clear before the work begins.

  • Overdue payments accrue interest at 1.5% per month or the maximum rate permitted by law, plus any collection costs.

5. Delivery, Shipping, and Pickup

  • Delivery and completion timelines are estimates only and not guaranteed.

  • We are not liable for delays caused by supply issues, force majeure events, or factors beyond our control.

  • Shipping arrangements and costs are your responsibility unless we agree otherwise in writing.

  • Risk of loss or damage passes to you upon handover to the carrier or upon pickup at our Southern Utah facility.

  • Local pickup is available by appointment.

6. Warranties and Disclaimers

  • We warrant that products will be free from defects in materials and workmanship and will substantially conform to agreed specifications for a period of 90 days from delivery or pickup.

  • This warranty does not cover damage from misuse, improper installation, modifications, normal wear, or failure to follow care instructions.

  • YOUR SOLE REMEDY FOR BREACH OF WARRANTY IS REPAIR, REPLACEMENT, OR REFUND (AT OUR OPTION).

  • ALL OTHER WARRANTIES, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE), ARE DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.

7. Returns and Refunds

  • Due to the custom nature of our products, returns and refunds are not accepted except for warranted defects.

  • Non-refundable deposits are forfeited if an order is canceled after acceptance.

8. Intellectual Property

  • You represent that any designs, drawings, or specifications you provide do not infringe third-party rights.

  • We retain ownership of our proprietary techniques, tools, and templates. You receive ownership of the physical product only.

9. Limitation of Liability

  • Our total liability for any claim shall not exceed the amount you paid for the specific order.

  • We are not liable for indirect, consequential, incidental, or punitive damages, even if advised of their possibility.

10. Force Majeure

  • We are excused from performance delays or failures caused by events beyond our reasonable control (e.g., natural disasters, labor disputes, material shortages, government actions).

11. Governing Law and Jurisdiction

  • These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.

  • Any disputes arising from these Terms or our services shall be resolved exclusively in the state or federal courts located in Washington County, Utah (or the county of our principal place of business).

12. Miscellaneous

  • These Terms constitute the entire agreement between you and us regarding the Website and services.

  • If any provision is held invalid, the remainder remains in effect.

  • We may assign these Terms; you may not without our consent.

13. Changes to These Terms

  • We may revise these Terms at any time by updating this page. Changes are effective upon posting. Your continued use of the Website or services after changes constitutes acceptance.
